General business terms for the mail order with customers

Termination of the contract, right of withdrawal 

For all business relations between the company amorchetti, Laura & Dieter Krautwald GbR, represented through Dieter Krautwald, Kanalstr. 15, 41460 Neuss, Germany (in the following “amorchetti”) and the customer, the following general business terms are being applied exceptionally in the version applicable at the respective time of order. No deviating terms of the customer will be accepted accordingly.

The demonstration of the products in amorchetti’s the online do not illustrate a legally binding offer, but an online-catalogue without any commitment whatsoever. You are processing a committing order of the items in your shopping cart through clicking onto the “Order”-button. The reception confirmation of your order is being created in line with the acceptance of your order instantaneously after sending an automated e-mail. This e-mail confirms the conclusion of the contract.

In case the customer is a consumer in the sense of § 13 BGB, he has the right to cancel his order within two weeks after receiving the ordered goods in writing, by telefax, or by email, or through sending the goods back to amorchetti. In order to stick to the respective deadlines, a duly sending of the goods is sufficient.

The right of withdrawal is assumed to be introduced with the execution of the order. After using the right of withdrawal the goods are to be sent back to amorchetti immediately. The re-sending of the goods has to be in an original condition and, if possible, in the original packaging. Amorchetti takes over the costs for the re-sending, in case the goods are damaged at the time of arrival at the buyer’s premises or if the order has been processed incorrectly by amorchetti. Do not send goods carriage forward. Carriage forward goods will not be accepted. The arising postal charges will be reimbursed by amorchetti. A right of withdrawal is not applicable for goods that have been fabricated after the specifications of the customer, especially if the goods have been fabricated after individual wishes of our customers, such as individual engravings.

Special remarks:

If you ordered a service, your right of withdrawal expires earlier in case your contract partner has started to process the service with your dedicated agreement before the end of your right of withdrawal, or you have initiated to do so yourself.The right of withdrawal is not applicable for goods that are mentioned in § 312 Abs. 4 BGB. This is, amongst others:

Shipment of goods that were processed after special customer specifications or are clearly cut to the personal needs of the customer. After agreement of the order an engravings order is being processed instantaneously, which is why a cancellation or a withdrawal is no more possible.

Shipment, passing of risk
Shipments are being made exceptionally to the respectively indicated shipment address. Within the Federal Republic of Germany the shipment will be charged with a flat charge of 3.90 €. For shipments outside the Federal Republic of Germany, the customer will be responsible to carry the real shipment costs, in so far as there are no specifications concerning the destination country are being indicated. Amorchetti has the right to deliver the goods in several shipments, in the case of which amorchetti will be responsible for additional shipment costs. Price, payment
Only the price indications made by amorchetti at the respective order time are applicable. All price indications include the legal taxes.The purchase price is to be paid immediately after the order after taxes and without discounts. The payment can be processed via credit card, Pay Pal, or by immediate bank transfer. Deliveries are only being processed upon payment. Even if goods are being processed and sent before the reception of the payment, the purchase price is due instantaneously.

Reservation of proprietary rights
All goods remain property of Laura and Dieter Krautwald GbR, proprietor of the amorchetti-online store until the final and entire payment of the selling price including all side liabilities.

Warranty
The warranty is being carried out after by law, whereas amorchetti reserves the right to fulfill additional deliveries in the case of a defect on the good, or in the event of reproduction. If a reproduction fails definitely, or the additional delivery is also defective, the customer has the right to give the good back upon reimbursement of the agreed price, or receive price discounts.

Exemption of liabilities

The customer agrees herewith that he will not attach the locks delivered by amorchetti to bridges, fences or other places, where it is obviously forbidden to do so. The customer herewith frees amorchetti from all associated liabilities for damage compensations of all kinds, that may arise from attaching the locks to forbidden places.

Place of fulfillment, Jurisdiction, applicable law
The legal relations between amorchetti and the customer are exclusively subject to the law of the Federal Republic of German under exemption of convention on the international sales of goods (CISG) and the rules of the international private law. Place of deliveries and payments is the head office of amorchetti. The Court of jurisdiction is, in case the customer does not have his main residence in the Federal Republic of Germany, also the head office of amorchetti. Amorchetti has the right to sue the customer at his respective Court of jurisdiction

Legal Effectiveness
In case parts or single formulations of this text is no more compliant with the actual law, the remaining parts oft he document and their validity remain inviolated.
